Israel has now joined other countries in allowing one to sign an enduring power of attorney. An enduring power of attorney provides great comfort as it allows one who has become unable to make decisions for themselves the ability to have their lives run for them by someone of their choice and according to their instructions. It allows an individual to prepare ahead of time.
The document grants the ability for the power of attorney to act in proprietary and medical matters. One of the most important aspects of the enduring power of attorney in Israel is a section in the power that gives the appointor a free hand to include matters that are important to them on a personal level. For example, one can instruct the power of attorney to give charity to designated by them. Gifts can be designated for birthdays, anniversaries, weddings etc. Instructions can be given relating to the running on investments, finances and many more matters.
Unlike when a guardian is appointed there is no obligation to file an annual report to the government, though one can opt for this. An executed enduring power of attorney also saves the stress of having to apply to the court and asking for a guardian. The enduring power ensures your wishes are fulfilled making it unnecessary to rely on a guardian who may not know your wishes.
There are of course restrictions on the what the power of attorney can do, there are also acts which require prior court approval.
