Setting Precedent
Simon represented a client who had won a Hague convention child abduction case. The client was not awarded any expenses or costs by the court. Simon advised the client to sue for costs and expenses in Israel. Simon argued that the guardian and custody rights of the father in Israel had been breached and was therefore entitled to compensation here in Israel for the breach of rights granted to a father by Statute. The court agreed with the argument and ordered the abductor to pay the costs and expenses. The defendant filed an appeal to the District court and the Supreme Court. Both the District and Suprem Courts rejected the appeal.
